Terms & Conditions

This is a working draft prepared from Osat’s own operating details. It is under legal review and may change before it becomes binding. For anything specific to your trip, the terms in your written booking confirmation take precedence.

These terms apply when you ask Osat International Tours & Travels (“Osat”, “we”, “us”) to arrange travel for you. They sit alongside the specific details in your written quote and booking confirmation; where the two differ, your booking confirmation applies.

Making a booking

You send us an enquiry, we prepare a quote, and a booking is confirmed only when we issue a written confirmation and you have paid the amount stated on it. Until then, prices and availability can change because they depend on airlines, lodges and other suppliers. Please check every name, date and detail on the confirmation immediately and tell us at once if anything is wrong.

Our role

For most trips we act as an agent, arranging services that are provided by third parties — airlines, safari and ground operators, lodges and hotels, transfer companies and insurers. Those services are also subject to the supplier’s own terms and conditions, which we will make available on request. Where we package and operate a tour ourselves, we say so in your confirmation and are responsible for that tour as the operator.

Prices and payment

Quotes are usually given in US dollars unless stated otherwise. Your confirmation sets out what is included, the deposit due to confirm, and the date the balance must be paid. If a balance is not paid by its due date, suppliers may cancel the arrangements and cancellation charges will apply. Some costs outside our control — for example government taxes, park fees or fuel surcharges — may change before travel; we will pass on only the actual difference.

Changes and cancellations

If you need to change or cancel a confirmed booking, tell us in writing as early as possible. What you can recover depends on the supplier terms for your trip plus our service fee; the figures are set out in our Cancellation Policy and in your confirmation. If we have to make a significant change or cancel — which is rare and usually caused by events beyond our control — we will offer you an alternative or a refund of what we can recover from suppliers.

Passports, visas and health

You are responsible for holding a valid passport, the correct visas, and any vaccinations or health documentation required for your trip. We will share the requirements we are aware of, but the final responsibility is yours, and we cannot refund a trip missed because a document was not in order.

Travel insurance

Comprehensive travel insurance is strongly recommended for every trip and is required for some safari and charter itineraries. It should cover medical treatment and evacuation, trip cancellation and curtailment, and baggage.

Liability

Where we act as agent, we are not liable for the acts, omissions or default of a supplier, or for events beyond our reasonable control — including weather, wildlife behaviour, strikes, civil unrest, road or airport conditions, and airline schedule changes. Nothing in these terms limits liability for death or personal injury caused by our negligence, for fraud, or for anything that cannot be excluded under Kenyan law. Subject to that, our liability for a booking is limited to the total amount you paid us for it.

Complaints

If something goes wrong during your trip, tell the supplier and contact us straight away on the 24-hour number in your itinerary so we have the chance to put it right. If it is not resolved, write to us at info@osatintltourstravels.com within 28 days of returning.

Governing law

These terms are governed by the laws of Kenya, and the courts of Kenya have jurisdiction over any dispute.
